Constitutionality of UIDAI and the ‘Aadhaar Scheme’

A batch of writ petitions has been filed before the Hon’ble Supreme Court, challenging the constitutionality of the Unique Identification Authority of India (UIDAI) and the Unique Identification Scheme (Aadhaar Scheme), on the main ground that it violates right to privacy under Article 21 of the Constitution of India.

Centre for Civil Society has filed an application for impleadment in the aforesaid writ petition, in support of the UIDAI and Aadhaar Scheme, on the ground that it will aid in effective implementation of welfare schemes and plug leakages. At the same time, the systems put in place under the Scheme ensure robust protection of privacy rights of all individuals.
